Chapter 7 bankruptcy

Chapter 7 bankruptcy is available to corporations, limited liability companies, partnerships, and proprietorships. We help you determine if Chapter 7 is the best solution for resolving your business finances by asking:

If you choose to file a Chapter 7 bankruptcy, you must also decide if it is going to be reorganized or liquidated. With Chapter 7, corporations are not discharged from their debts. Debts must still be paid to creditors to the extent that assets are available and by the priority of the claim. However, it is a means of liquidation. Funds resulting from the liquidation of the assets are used to pay for Chapter 7 filing expenses, taxes, and then creditors.

Corporations and limited liability companies cannot file for a Chapter 13 bankruptcy. If you are a sole proprietor or partnership, the advantage to filing a Chapter 13 is the ability to pay back debts instead of liquidating them.
